We are encountering an issue when a staff person exceeds 40hrs. while accompanying a client on a trip. We are paying more per hour to the staff person than we are reimbursed for the service. I was told by the Department of Labor that we cannot limit the number of hours that a staff person can bill when they are with a client on a trip. If a staff person cannot leave, they are considered working. How do you accommodate individual client trips/vacations?

Our policies states that clients cannot leave bordering states. Tabitha Taylor ttaylor@focusinc.org When we go to State Special Olympics in Searcy, our staff, whether program or DSP, clocks in at 6 am when they get the client up and stays clocked in until 10 when we make it lights out and the client has to stay in their room unless they get us for an emergency.
